Using Legal Tools to Protect Water Resources
Water laws and policies developed in the Nineteenth and Twentieth Centuries don’t necessarily facilitate solutions to Twenty-first Century water quality, water shortage or demand relocation problems. They also emphasize consumptive use of water rather than natural uses of water in situ, where the natural species live. We encourage creative change of outdated law where possible. Legislation and litigation are both powerful fora where organizations and governments may secure justice for vulnerable water systems and creatures.
This reality is particularly acute where the impacts of climate change worsen water conflicts. The Nooksack River watershed in northwest Washington is such a case. Current litigation related to that river and related groundwater may set precedents that could lead to better water management and stronger environmental protections.
